MERCHANT PROCESSOR SOLUTIONS (“MPS,” “we,” “our,” “us”) is an organization that offers payment processing solutions and merchant services in Canada and in the United States. We are committed to protecting the privacy and security of your Personal Information.

Purpose of this privacy policy

MPS is a responsible organization operating in Québec, Canada. As a result, we adhere to the requirements and obligations outlined in Quebec’s Act respecting the protection of personal information in the private sector.

As part of our regular operations, we collect, use, and process Personal Information for the purposes of providing our services. When you share with us with your Personal Identifying Information or “PII” via our website (https://merchantprocessorsolutions.com/, the “Site”), by email, in person, or by telephone, you agree that it will be processed by our organization and its service providers in accordance with the dispositions contained in the present Policy.

Therefore, this Policy aims to inform you about our practices regarding the collection and use of your PII, your rights pertaining to the same, and how you may contact us to exercise these rights.

Personal information we collect

We may obtain information that you provide directly to us when you interact with our website (e.g., when you fill out our contact form, when you chat with us, or when you call the contact center). This information includes the following:

If we become aware that we have collected PII from a child under the age of 14 without parental consent, we will take steps to remove that information.

Vendor integrations and features. We may engage vendors to provide certain interactive features on our Site. These vendors provide services like Chat, Forms, and Telephone services. If you use these interactive features, we may retain the information that you will submit through same. In addition, by using these features, you understand that our vendors may process the Personal Information obtained thereby to provide the service on our behalf and that the contents thereof may be captured and kept as a transcript or a voice recording. Linked websites. The Site may include links to websites that are owned and/or operated by external parties. This Privacy Policy does not apply to those websites, which may have their own Privacy Policies or Notices. MPS is not responsible for the content or privacy practices of any such linked websites. As a result, we recommend that you review their Privacy Policy (as the case may be) before you disclose any Personal Information.

How do we use your PII

We may use the PII we obtain as described herein for the following purposes:

  • Facilitate and personalize your user experience;
  • Monitor and analyze trends, usage, and activities of visitors and users of the Site;
  • Administer and improve the Site, our marketing, or services we may offer;
  • Deliver promotional/marketing content to you;
  • Provide the information you requested about our services;
  • Sign you up for our guide or newsletter;

Limited Data Sharing. Your Personal Information will be used in accordance with Quebec’s Act respecting the protection of personal information in the private sector and the conditions contained herein. To that end, MPS will only give access to your PII to employees or third parties as required for the purposes indicated in the present Policy.

Disclosure of personal information

Depending on the service or transaction that you may have requested, we may disclose your PII to the following persons or entities:

  • Our subsidiaries and affiliates to support our business operations;
  • Third party service providers and/or partners who provide website, administrative support, maintenance, and other services to us;
  • Government, regulatory, or law enforcement agencies when we are required to disclose this information or believe in good faith that such disclosure is necessary to comply with applicable laws;
  • Our professional advisors, bankers, and auditors; or
  • Parties involved in a business transaction, such as if we sell or transfer all or a portion of our business or assets (e.g., further to a merger, reorganization, liquidation, or any other business transaction, including negotiations of such transactions).

How long will we retain your PII?

We retain Personal Information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, or as required by law.

We will therefore stop using your Personal Information as soon as this purpose has been achieved. Thereafter, your PII will be destroyed in accordance with our retention and destruction policy, the whole subject to any applicable law or regulation. As the case may be, we may choose to deidentify your PII for serious and legitimate purposes, on the whole in accordance with applicable legislation.

Where do we keep your PII?

We secure the Personal Information you provide on computer servers located in Québec (Canada) and in the United States in controlled, secure environments, protected from unauthorized access, use, modification, copying, or disclosure.

If international transfer of data outside Québec is required by our Service Providers to perform their functions, MPS’s Privacy Office will conduct a Privacy Impact Assessment and secure a Privacy Agreement with the parties concerned prior to any such transfer to ensure that the Personal Information involved will receive adequate protection.

How do we protect your PII?

We recognize that information security is an integral part of the privacy of Personal Information. While transmission via the Internet and online digital storage are not completely secure, we take reasonable measures to protect your PII from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. To that end, we implement industry best practices to ensure the protection of Personal Information.

This is why we maintain reasonable physical, technical, organizational, and legal safeguards to protect your Personal Information against unauthorized consultation, use, modification, disclosure and/or destruction that does not comply with applicable law.

All members of MPS and third-party suppliers whose services we may retain and who process Personal Information on our behalf are also contractually bound to respect the confidentiality of Personal Information.

Service providers. As they may need to access or process Personal Information as part of the services they provide to us, we limit the information we provide them to the information that is reasonably necessary for them to perform their functions. The written contracts we have with these service providers require them to take reasonable measures consistent with the law to ensure the confidentiality of this information. Service Providers are not authorized to use or disclose your information except as necessary to perform specific services on our behalf or to comply with legal requirements.

Data Privacy Officer. To ensure compliance with and application of this Policy, and to provide any person with the necessary support needed in the event of a question, complaint, or request relating to the protection of Personal Information, MPS has designated a Data Privacy Officer whose coordinates are provided hereafter.

Data breach

In the event we become aware that the Personal Information we collect has been compromised or unlawfully disclosed as a result of internal or external activity, including, but not limited to, theft, security attacks, or fraud, we will endeavor to take reasonably appropriate measures to reduce the risk of prejudice and injury including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. We will also undertake steps to reduce or prevent new incidents of the same nature from reoccurring in the future.

In the event of a data breach involving Personal Information, if the incident presents a risk of serious injury, we will make reasonable efforts to promptly notify any person whose Personal Information is concerned including notifying the CAI (Commission d’accès à l’information) if the breach concerns a resident of Québec.

What are your rights pertaining to PII?

Rights of access, rectification, and withdrawal of consent. To have access to your Personal Information, to request a rectification of your Personal Information, to withdraw your consent to the communication or use of your Personal Information, or for any other query you might have about your PII, you must send a written request to our Data Privacy Officer (contact details can be found at the end of this Policy). Any such request must be sufficiently precise to allow MPS to adequately respond to the same and to identify you. In the event you withdraw your consent pertaining to the use of your PII, please note this may result in the termination of the services provided to you by MPS.

Processing requests. MPS will normally respond to requests for access, rectification, or withdrawal of consent within 30 days and in accordance with the deadlines prescribed by Quebec’s Act respecting the protection of personal information in the private sector. All necessary assistance will be reasonably provided to those individuals who wish to access or correct their Personal Information, including clarifying what exactly they are seeking. Depending on the volume of information implied in each request, a nominal fee may reasonably be charged to cover the costs associated with same. Written notification will be provided if MPS must deny the individual access to their Personal Information for legal, regulatory, or other reasons.

Appeal rights before the Commission for Access to Information. If you are not satisfied with the way in which MPS has handled your request for access or rectification of your Personal Information, you may file a complaint with the Commission for Access to Information.

Users outside Québec, Canada

If you are visiting our website from outside Québec, please be aware that information we obtain about you will be processed in Québec (Canada) and that some data may be stored on servers in the USA.

By using the Site, please be aware that the data protection laws and regulations that apply to your Personal Information may be different from the laws in your country of residence.
